Pengambilan tanah bagi pembangunan ekonomi: isu dan penyelesaian. Jurnal Undang-undang dan Masyarakat (JUUM), 15. pp. 135-147. ISSN 1394-7729 (2011)
Abstract
Rapid growth and enormous changes to the economy have created a vast array of novel business opportunities. This phenomenon has resulted in the acquisition of a huge number of private lands for various economic development purposes including the construction of shopping complexes, stadiums, power stations and highways. The Land Acquisition Act 1960 is a piece of legislation that has specifically been enacted to acquire private lands from individuals for the development of Malaysian economy. Nonetheless, ambiguity to the Act is a source of discontent to the people as it is alleged that the Act merely safeguards the benefits of certain groups and not the interests of the public at large. Various issues relating to the land administration system, compensation, unused lands, acquisition of customary and Malay reserved lands and fraudulent change of ownership to the land titles are central to the people grievances. In relation thereof, this study intends to analyse these aforementioned issues and where possible, to propose appropriate recommendations that are likely to uphold the interests of all related parties.
